Brrikkho.com (referred to as “Brrikkho,” “we,” “us,” or “our”) operates an online business in Bangladesh offering plants, live plants, flowers, pots, planters, soil, fertilizers, gardening supplies, gifts, and related products. These Terms of Use (“Terms”) govern your use of brrikkho.com, its mobile version, related subdomains, online features, customer-support channels, ordering systems, and other digital services made available by Brrikkho.

By browsing the Website, creating an account, adding a product to your cart, placing an order, making a payment, or using any of our digital services, you agree to these Terms, our Privacy Policy, Shipping Policy, and 7-Day Guarantee, each of which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not use the Website or place an order.

These Terms apply only to the extent permitted by applicable law. If any provision is found to be invalid or unenforceable, the remaining provisions will remain in effect. Nothing in these Terms is intended to exclude or restrict any mandatory consumer-protection right or other legal right that cannot lawfully be excluded or restricted.

Definitions

“Customer,” “you,” or “your” means any visitor, account holder, or person who purchases or receives a product or service from Brrikkho. “Products” means live plants, flowers, pots, planters, soil, fertilizers, gardening tools, accessories, gifts, and other products listed on the Website. “Live Products” means plants, flowers, or other living botanical products that naturally vary in size, color, shape, foliage, roots, maturity, and overall appearance. “Order” means a purchase request submitted through the Website. “Business Day” means a day other than a public holiday in Bangladesh.

Permitted Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. You must not attempt to damage, disable, overburden, disrupt, or gain unauthorized access to the Website or its security systems. You must not introduce viruses, malware, malicious code, or unauthorized scripts; use another person’s account, identity, phone number, email address, or payment details; or upload or distribute fraudulent, misleading, defamatory, obscene, threatening, discriminatory, or unlawful material.

Without our prior written permission, you must not use robots, spiders, scrapers, data-mining programs, automated purchasing tools, or other automated methods to access, copy, monitor, or collect information from the Website. You must not use the Website to collect prices, product information, customer information, inventory data, or other market intelligence for a competing business.

Brrikkho may refuse, restrict, suspend, or terminate access to the Website or any part of it where we reasonably believe that a user has violated applicable law, these Terms, another person’s rights, or the security or proper operation of the Website.

Age, Accounts, and Accuracy of Information

You must be at least 18 years old to place an order, or the order must be placed by your parent or legal guardian. A person under 18 may browse the Website only with the knowledge and supervision of a parent or legal guardian, and all purchases and contractual transactions must be authorized by that parent or guardian.

If you create an account, you must provide true, complete, current, and accurate information, including your name, phone number, email address, delivery address, and any other information reasonably requested. You are responsible for keeping your login details confidential, monitoring activity under your account, and notifying us promptly if you suspect unauthorized access or use.

If the delivery address, phone number, or other information you provide is incorrect or incomplete, the order may be delayed, returned, cancelled, or subject to a re-delivery charge. Brrikkho is not responsible for losses caused by inaccurate information supplied by you, although we may provide reasonable assistance where possible.

Products, Images, and Natural Variation in Live Plants

Images, measurements, colors, fullness, flowering condition, number of leaves, and general appearance shown on the Website are generally representative. A Live Product may not be identical to the image displayed online. Natural differences may result from the plant’s age, season, light, watering, humidity, temperature, transportation, packaging, nursery, and growing conditions.

Minor leaf drop, soil displacement, one or two bent or yellowing leaves, a need for light pruning, natural root variation, or temporary stress after transportation does not necessarily constitute a defect or material damage. Serious damage, an incorrect product, a plant that arrives dead, or another issue covered by our published guarantee may qualify for a remedy under Section 9.

We do not guarantee that a particular species, size, color, flowering condition, or stock level will always be available. If a product becomes unavailable after you place an Order, we may notify you and offer cancellation, a comparable alternative, store credit, or a refund where applicable. We will not send a materially different or higher-priced substitute without your consent.

Plant-care information regarding light, water, fertilizer, pruning, toxicity, and household safety is provided for general informational purposes only. Results vary according to the customer’s environment and care. Some plants may be toxic to humans or animals if ingested or handled improperly. You are responsible for checking whether a Product is suitable for your household. Do not ingest any plant or use any plant or gardening product as medicine or as a substitute for professional medical advice.

Product Prices and Orders

Prices are displayed in Bangladeshi Taka (BDT or ৳), unless otherwise stated. Product prices, discounts, delivery charges, gift wrapping, special packaging, surcharges, and other applicable charges will be shown before checkout. Taxes, government charges, or payment-related charges may apply where displayed at checkout or required by applicable law.

If a material error appears on the Website in relation to a price, image, stock status, product description, or technical detail, we may correct the error before accepting the Order. If a material error is discovered after payment, we will notify you as soon as reasonably practicable and, depending on the circumstances, offer cancellation with a refund of the amount due or an opportunity to proceed at the corrected price.

After you submit an Order, you may receive an on-screen, email, or SMS acknowledgment. This acknowledgment confirms that we received your Order; it does not necessarily mean that the Order has been finally accepted. Final acceptance may be subject to product availability, address verification, payment authorization, fraud screening, and other reasonable checks.

Brrikkho may cancel or refuse an Order for reasonable reasons, including product unavailability, an apparent pricing or stock error, an incorrect or incomplete address, suspected fraud, unusual order quantities, payment failure, transportation or safety concerns, or a legal requirement. If we have already received payment for a cancelled portion of an Order, we will arrange a refund through the same or another lawful payment method, subject to the relevant payment provider’s processing rules.

Payments and Payment Service Providers

You agree to pay the total amount shown at checkout, including the product price, delivery charge, and other applicable charges. Brrikkho may use third-party payment gateways, mobile financial services, banks, and other payment providers, including bKash, Nagad, SSLCommerz, or other providers displayed at checkout from time to time.

Do not send your card number, mobile-wallet PIN, OTP, password, or other sensitive payment credentials to Brrikkho by email, chat, or social media. Authorization, charging, reversal, chargeback, security verification, and transaction processing may be subject to the terms and policies of the relevant payment provider.

If payment fails, the Order may not be completed. If you believe that you have been charged more than once for the same Order, contact us promptly with the transaction details so that we can investigate and coordinate with the relevant payment provider.

Delivery and Customer Cooperation

We aim to deliver Products within the delivery areas shown on the Website in Bangladesh. Delivery times depend on the Product, stock, delivery address, season, weather, carrier, public holidays, and other practical circumstances. Any delivery estimate shown on the Website is an estimate and is not a guaranteed deadline unless expressly stated otherwise in a written offer.

Products in the same Order may arrive in multiple packages, at different times, or from different locations or partners. You must provide a complete and accessible address, remain reasonably available by phone, and cooperate with the delivery process. If no one is available to receive the Product, the address is incorrect, you cannot be contacted, or a cash-on-delivery package is refused, the Order may be delayed, returned, cancelled, or subject to a re-delivery charge.

We are not responsible for carrier delays or disruptions caused by circumstances beyond our reasonable control, including strikes, natural disasters, flooding, extreme weather, road closures, government directions, public health emergencies, political disruption, or other force majeure events. Where reasonably possible, we may hold a Live Product temporarily for safe shipment and notify you of the expected change.

7-Day Customer Happiness Guarantee

Under our 7-Day Guarantee, an online purchase of a Live Product may qualify for a replacement, comparable alternative, store credit, or refund where the Product arrives with serious transportation damage, arrives dead, or has another material issue covered by the guarantee, provided that you notify us within the first seven days after receipt. This guarantee does not limit any mandatory legal right available to you.

To make a claim, contact us through our support channel and provide the Order number, delivery date, a description of the issue, and clear photographs. Where possible, include photographs of the outer packaging, the entire plant, and close-up photographs of the damage. Photograph the Product before pruning, repotting, watering, or otherwise modifying it, and retain the packaging and shipping label until the claim is reviewed.

Minor leaf drop, soil displacement, temporary stress after transportation, natural variation in appearance, damage caused by unsuitable light, watering, temperature, or humidity after delivery, neglect, unauthorized repotting, or a new pest or disease infestation will generally not be covered. Unless expressly stated otherwise, Live Products are not ordinarily returnable because they are perishable and living products.

Replacements depend on availability. If the original Product is unavailable, we may offer a comparable alternative or another remedy agreed with you. If return of the Product is required, follow our written instructions and do not send it back at your own expense before receiving those instructions.

Returns, Cancellations, and Refunds for Non-Live Products

The return, exchange, cancellation, and refund rules for non-live Products will be stated on the relevant product page, our Shipping Policy, or the order-specific instructions. If you receive the wrong Product, a defective Product, or a Product materially different from its published description, notify us promptly with the relevant Order details and evidence.

Where a refund is approved, processing time may depend on the original payment method, bank or mobile financial service, payment-provider procedures, and any required verification. Discounted, customized, opened, used, hygiene-sensitive, or expressly marked “non-returnable” Products may be subject to special rules. No term in this section is intended to remove a remedy that cannot lawfully be removed under applicable law.

Plant Care, Safety, and Use at Your Own Risk

Plant-care guidance provided by Brrikkho is general information and is not advice from a medical professional, veterinarian, agricultural specialist, or plant-disease specialist. Follow the instructions on fertilizer, pesticide, fungicide, soil, and gardening-tool packaging. Keep potentially hazardous products, sharp tools, soil additives, and toxic plants away from children and pets.

You are responsible for assessing whether a Product is suitable for your lighting, ventilation, humidity, temperature, pets, children, allergies, and household safety conditions. Brrikkho does not guarantee that a particular plant will survive, flower, or thrive in your specific environment. If a plant or gardening product is ingested or causes an allergic reaction or injury, seek appropriate professional or medical assistance.

Intellectual Property

The text, product descriptions, photographs, videos, graphics, logos, brand names, designs, layout, software, data, plant-care materials, and other materials on the Website (“Brrikkho Content”) are owned by Brrikkho or its licensors and are protected by applicable intellectual-property laws. You may access and print limited portions of the Website for personal, non-commercial use. Without our prior written permission, you may not copy, reproduce, republish, sell, modify, download, distribute, commercially exploit, create a database from, or make misleading use of Brrikkho Content.

The Brrikkho name, logo, trademarks, domain name, and brand assets may not be used without our prior written permission. Third-party names and logos remain the property of their respective owners.

Reviews, Photos, and User-Submitted Content

If you submit a review, comment, photograph, video, question, suggestion, or other content, you represent that you own it or have the necessary rights to submit and use it; that it does not contain another person’s private information or image without permission; and that it is not unlawful, defamatory, misleading, or infringing.

You retain ownership of your content. However, by submitting it, you grant Brrikkho a worldwide, non-exclusive, royalty-free license to store, display, reproduce, edit, translate, republish, distribute, share on social media, and use the content for Brrikkho’s business and marketing purposes, subject to applicable law and respect for your personal rights. If you do not want a photograph or review used for marketing, state that clearly when submitting it or contact us in writing.

Brrikkho is not required to publish or retain submitted content and may remove content that violates law, safety requirements, quality standards, relevance requirements, or these Terms.

Communications, Marketing Messages, and Cookies

When you contact us, we may use the information in your communication to respond to your question, provide order support, investigate a complaint, and maintain appropriate business records. Do not send confidential or sensitive information through ordinary email, chat, or social-media messages.

We may send transactional messages relating to order confirmation, payment, delivery, OTP, security, and essential service updates. If you opt in to promotional email or SMS marketing, you may unsubscribe using the link in an email or by following the “STOP” or other opt-out instructions in an SMS. The collection and use of personal information and cookies are described in our Privacy Policy.

Third-Party Services and Links

The Website may include payment gateways, delivery partners, social-media features, analytics services, advertising services, or links to third-party websites. Those third parties may have their own terms, prices, privacy policies, and security practices. Brrikkho is not responsible for the content, availability, delay, security, or policies of third-party services, although we may provide reasonable assistance with an Order-related issue.

Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the Website, Brrikkho Content, and digital services are provided on an “as is” and “as available” basis. We do not guarantee that the Website will always be uninterrupted, error-free, secure, complete, or compatible with every device. We do not knowingly authorize false product descriptions, deceptive advertising, or unlawful business practices.

To the maximum extent permitted by law, Brrikkho will not be liable for indirect, incidental, special, consequential, or punitive losses, loss of profits, loss of data, or business interruption arising from your use of, or inability to use, the Website, a third-party service, or a Product that was improperly cared for after delivery. This limitation does not apply to fraud, intentional misconduct, gross negligence, death or personal injury, a mandatory consumer right, or any liability that cannot lawfully be excluded.

Where legally permitted, Brrikkho’s total liability in relation to a particular Order will not exceed the amount you paid for that Order. This limitation is not intended to restrict any remedy that applicable law requires us to provide.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Brrikkho, its personnel, representatives, and service providers from third-party claims, losses, reasonable costs, or legal expenses directly arising from your intentional misuse of the Website, fraud, violation of these Terms, infringement of another person’s rights, unlawful content, or unauthorized use of your account. This section does not transfer Brrikkho’s own unlawful conduct, fraud, or non-excludable legal responsibility to you.

Suspension and Termination

You may stop using the Website or request closure of your account at any time. Brrikkho may suspend or terminate an account or service because of security concerns, fraud, payment problems, abusive ordering behavior, a violation of these Terms, or a legal requirement. Any rights relating to an Order or payment that arose before termination will be handled under applicable law, the relevant refund or guarantee policy, and these Terms. Provisions concerning intellectual property, privacy, liability, indemnification, dispute resolution, and other provisions that naturally survive termination will remain effective.

Complaints and Dispute Resolution

If you have a problem, please first contact us through our Contact Us page or at info@brrikkho.com with your Order number, name, phone number, description of the issue, and relevant photographs or evidence. We will review the matter and attempt to resolve it within a reasonable time.

If a dispute cannot be resolved informally, these Terms and your transactions with Brrikkho will be interpreted under the applicable laws of Bangladesh. The parties will first attempt to resolve the dispute through good-faith discussion. If discussion does not resolve the matter, either party may seek relief from a competent court or authority in Bangladesh in accordance with applicable law. Nothing in this section removes a consumer’s mandatory right to submit a complaint, seek administrative relief, pursue a civil remedy, or access a court or other legally available forum.

Changes, Notices, and General Terms

Brrikkho may update these Terms to reflect changes in our business, Products, technology, or legal requirements. When we update them, we will change the “Last Updated” date and publish the revised version on the Website. Continued use of the Website after the revised version is posted means that the revised Terms apply to future use. Unless applicable law requires otherwise, the Terms in effect when an Order was accepted will continue to apply to that Order.

These Terms, our Privacy Policy, Shipping Policy, 7-Day Guarantee, and any additional terms clearly displayed during checkout or on a Product page form the agreement between you and Brrikkho regarding the Website and the relevant Order. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not transfer your rights or obligations under these Terms without our written consent.
